Terms of service

Effective date: 25 August 2026

Please read these Terms of Service carefully. They contain a binding arbitration provision and a class-action waiver in section 19, which affect how disputes between us are resolved. You may opt out of arbitration within 30 days, as described there.

1. Who we are, and what these terms cover

US BookGram ("US BookGram", "we", "us", "our") operates the online store at usbookgram.com, including all related content, features, tools, products and services (the "Services"). Our store is powered by Shopify.

These Terms of Service, together with our Refund Policy, Shipping Policy, Privacy Policy, and the buyback terms published at Sell your books (together, the "Terms"), govern your use of the Services. By visiting, browsing, or ordering from us, you agree to them. If you do not agree, please do not use the Services.

2. Eligibility and your account

You must be at least the age of majority in your state or province of residence to buy from us. If you allow a minor in your care to use the Services on a device you control, you are responsible for their use of it.

You may create an account, or check out as a guest. If you create an account you agree to give accurate, current and complete information, to keep your login credentials secure, and to tell us promptly if you believe your account has been used without your permission. You are responsible for activity on your account. Accounts may not be sold, transferred or shared.

3. The books we sell

We sell new textbooks sourced from publishers and authorised distributors. We do not stock used, ex-library, or international editions.

Editions and ISBNs. Every listing identifies the exact edition by its 13-digit ISBN. The ISBN, not the title or the cover image, is the definitive description of what you are buying. Covers, page counts and packaging vary between printings, and cover images are illustrative. Please check the ISBN against your reading list before ordering, as editions differ in content, pagination and problem sets.

We do not guarantee course suitability. Reading lists change, instructors substitute editions, and course requirements are set by your institution, not by us. Confirming that a book is the one your course requires is your responsibility.

Access codes. Where a publisher packages a single-use access code with a book, we say so on the listing. Codes are issued, hosted and supported by the publisher, not by us. We do not warrant that any code will work with your institution's systems, that a platform will remain available, or that a code has any particular period of validity. Once a code's seal is broken or the code is redeemed, the book cannot be returned. See the Refund Policy.

Descriptions and availability. We work to describe our books accurately, but colours and appearance may differ on your screen. Descriptions may be changed at any time, we may discontinue any title, and we may limit quantities available to any person, region or jurisdiction.

4. Orders

Placing an order is an offer to buy, not a completed sale. We may accept or decline any order at our discretion, and your order is not accepted until we confirm acceptance and we have received and processed your payment.

We may decline, cancel or limit an order where a title is out of stock, where pricing or product information was stated in error, where we suspect fraud or an unauthorised payment method, or where the order appears to be for commercial resale. If we decline or cancel, we will try to contact you at the email, billing address or phone number on the order, and we will refund any payment taken.

Please review your order before submitting it. Once an order has been handed to the carrier we may be unable to change or cancel it, and it must then be handled as a return. We dispatch every day at 5:00 PM ET; a cancellation request received before dispatch will be honoured in full.

Books are sold for your own personal or educational use and not for commercial resale or export.

5. Prices, taxes and payment

Prices, discounts and promotions can change without notice. The price that applies is the one in effect when your order is placed, as set out in your order confirmation. Posted prices exclude taxes, shipping, and any customs or import charges unless we say otherwise.

Despite our best efforts, a listing may occasionally contain a pricing or description error. Where a price is obviously wrong, we reserve the right to cancel the order and refund you in full, even after the order was submitted, rather than to honour the error.

You warrant that the payment details you give us are accurate, that you are authorised to use the payment method, and that you will pay all charges incurred, including shipping and any applicable taxes. Payments are processed by Shopify and its payment partners; we do not store full card numbers.

6. Shipping, delivery and risk

Our Shipping Policy forms part of these Terms and sets out our dispatch cutoff, carriers and tracking. In summary: we ship daily at 5:00 PM ET, we choose the carrier, expedited service is included at no additional cost, and delivery dates are estimates rather than guarantees.

Title and risk of loss pass to you when we transfer the books to the carrier. We are not liable for delay or non-delivery caused by the carrier, by customs, by weather, or by any other cause outside our reasonable control, though we will help you pursue a carrier claim.

You are responsible for providing a complete and accurate delivery address. Once an order has shipped we are often unable to change the address or redirect the parcel.

International orders. Duties, taxes, customs charges and carrier handling fees are set by the destination country and are your responsibility. Refusing a parcel does not remove them, and they are not refundable by us.

7. Returns and refunds

Returns are governed by our Refund Policy, which forms part of these Terms. In summary: you have 14 days from delivery to request a return; the book must come back unused and complete; books packaged with an access code can be returned only with the code sealed and unredeemed; we pay return postage and refund original shipping where the error was ours; and approved refunds are issued to the original payment method within 10 business days.

Nothing in these Terms limits any non-waivable statutory rights you have under the consumer law of your state or country.

8. Selling your books to us (buyback)

We buy a narrow list of titles on the terms published at Sell your books, which form part of these Terms. Those terms include what we buy and do not buy, our flat per-book rates, a minimum of five accepted books per shipment, and the fact that you pay the postage.

When you send us books, you represent and warrant that you own them outright and have the right to sell them; that they are not stolen, not the property of a library or institution, and not subject to any rental, loan or lien; and that they are not review, instructor, or otherwise not-for-resale copies.

You also agree that:

  • We grade on arrival, and our grade is the one that applies. Our quote is based on the ISBNs you send us; the condition we assign on inspection determines what you are paid.
  • Risk in transit is yours. Until a shipment reaches us it is your responsibility, and we recommend a tracked service. We are not liable for books lost or damaged on the way to us.
  • Title passes to us on acceptance. Once we accept a book and issue payment or credit, it is ours to sell, donate or recycle.
  • Books graded below Good are recycled rather than returned, and shipments below the five-book minimum are returned unopened at your cost, as stated in the buyback terms.
  • Offers expire. A quote is held for 14 days from the date of our email.
  • Payment is in store credit by default. Cash payment is by cheque, issued within 30 days of inspection.

9. Store credit

Store credit and gift cards issued by us may be redeemed only at usbookgram.com. They are not redeemable for cash except where the law requires it, they cannot be transferred for value, and they are not reloadable. We are not responsible for credit lost or used by someone to whom you gave the code.

10. Acceptable use

You may use the Services only for lawful purposes. You may not:

  • use the Services for any unlawful, fraudulent or malicious purpose, or in breach of any applicable law or regulation;
  • infringe our intellectual property rights or anyone else's;
  • harass, abuse, threaten, defame or harm our staff or any other person;
  • submit false or misleading information, or impersonate anyone;
  • upload viruses or other malicious code, or otherwise interfere with the operation or security of the Services;
  • scrape, harvest, copy, resell or systematically extract any part of the Services, including our catalogue, pricing or listing content;
  • collect or track other people's personal information; or
  • bypass, disable or circumvent any security measure, rate limit, robots directive or access restriction we use.

We may suspend or terminate access at any time, without notice, if we believe you have breached this section.

11. Automated agents

This section applies if you use, deploy, or cause the deployment of an Agent that accesses or interacts with the Services. "Agent" means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, without direct supervision.

An Agent may access the Services only if it identifies itself and complies with the following at all times, and only if we have not asked it to stop. We may limit, including by technical means, whether and how any Agent accesses the Services. An Agent must:

  • identify itself in every HTTP/HTTPS request by including Agent/[agent name] in the user agent string;
  • not conceal that the access is automated, including by mimicking human interaction patterns or by completing or circumventing CAPTCHAs or other human-verification measures;
  • answer truthfully any prompt asking whether the interaction comes from a human or a computer; and
  • not circumvent any measure intended to block, limit or control automated access.

12. Intellectual property

The Services, including their text, images, product photography, listing copy, graphics, design, selection and arrangement, are owned by US BookGram or its licensors and are protected by copyright, trademark and other laws. These Terms permit you to use the Services for your own personal, non-commercial purposes only. You may not reproduce, distribute, modify, publish, republish, store, transmit or create derivative works from any part of the Services without our prior written consent.

Copyright in the books we sell belongs to their respective publishers and authors. Nothing in a sale grants you any right in the content of a book beyond the rights the publisher gives you.

"US BookGram" and our logo are our trademarks. Shopify's name and logo are trademarks of Shopify. All other marks appearing on the Services belong to their respective owners.

13. Reviews and feedback

If you submit a review, suggestion, idea or other material ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish and display it in any medium, including for commercial purposes, without compensation or any obligation of confidence.

You confirm that your Feedback is your own, that it does not infringe anyone's rights, that it is not unlawful, abusive, obscene or defamatory, and that you have disclosed any compensation or incentive you received in connection with it. We may, but are not obliged to, monitor, edit or remove Feedback. We are not responsible for Feedback posted by anyone.

14. Relationship with Shopify

US BookGram is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with US BookGram. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and US BookGram, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with US BookGram.

15. Third-party links and tools

The Services may link to, or make available, materials, sites and tools operated by third parties, including publisher access-code platforms and payment providers. We do not control them, we do not review them, and we are not responsible for their content, accuracy, or practices. Access them at your own risk and read their terms. Complaints about a third party's product or service should be directed to that third party.

16. Privacy

Personal information collected through the Services is handled as described in our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes information about your use of the Services in order to provide and improve them, and information you submit may be transmitted to Shopify and to service providers that may be located in other countries.

17. Disclaimer of warranties

Information on the Services is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY US, AND EXCEPT FOR ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

18. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, US BOOKGRAM AND ITS OWNERS, EMPLOYEES, CONTRACTORS, SUPPLIERS AND SERVICE PROVIDERS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, LOSS OF DATA, OR LOSS OF ACADEMIC OR PROFESSIONAL OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR ANY PRODUCT BOUGHT THROUGH THEM, WHETHER THE CLAIM IS IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR ANY ORDER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

19. Disputes: informal resolution, then arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIM.

19.1 Talk to us first

Most problems are a misunderstanding about an order and can be fixed in a day. Before starting any formal proceeding, you agree to send a written description of the dispute, your order number and the outcome you want to support@usbookgram.com, and to give us 30 days to resolve it. We agree to do the same before bringing a claim against you.

19.2 Binding individual arbitration

If we cannot resolve the dispute informally, you and US BookGram agree that any dispute, claim or controversy arising out of or relating to these Terms, the Services, or any order — including its formation, interpretation, breach, or termination, and including claims that arose before these Terms took effect — will be resolved by binding individual arbitration rather than in court.

The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, as modified by this section. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.

Arbitration may be conducted on documents alone, by telephone or by video conference. Any in-person hearing will be held in Fresno County, California, or in the county where you live, at your choice. Filing and arbitrator fees are allocated under the AAA Consumer Arbitration Rules.

19.3 Small claims

Either of us may bring an individual claim in small claims court instead of arbitration, if the claim qualifies and stays in that court.

19.4 Class-action waiver

You and US BookGram agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — must proceed in court, and the rest of this section 19 still applies to all other claims.

19.5 Your right to opt out

You may opt out of this arbitration agreement. Send written notice within 30 days of first accepting these Terms to support@usbookgram.com, or to US BookGram, 2894 S Orange Ave, Fresno, California 93725, United States, stating your name, the email address on your account or order, and that you are opting out of arbitration. Opting out affects nothing else in these Terms, and it will not affect your orders or your relationship with us in any way.

19.6 Governing law and venue

These Terms and any dispute between us are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Where a dispute proceeds in court rather than arbitration, you and US BookGram consent to the exclusive jurisdiction and venue of the state and federal courts located in Fresno County, California.

20. Indemnification

You agree to indemnify and hold harmless US BookGram, Shopify, and our respective owners, officers, employees, agents and service providers from any losses, damages, liabilities and claims, including reasonable legal fees, arising out of your breach of these Terms, your violation of any law or third-party right, or your use of the Services. We will notify you of any such claim, may control its defence at your expense, and will not settle a claim imposing non-monetary obligations on you without your consent, which you will not unreasonably withhold.

21. Termination

We may suspend or terminate your access to the Services at any time, at our discretion, and you remain liable for amounts owed up to that date. The following survive termination: sections 8 (buyback warranties), 12 (intellectual property), 13 (feedback), 17 (warranties), 18 (liability), 19 (disputes), 20 (indemnification), and 22 (general), together with any other provision that by its nature should survive.

22. General

  • Changes. We may update these Terms by posting a revised version with a new effective date. Material changes take effect as required by law, and your continued use of the Services after they take effect is acceptance. Changes to section 19 do not apply retroactively to a dispute of which we already had notice.
  • Severability. If any provision is held unlawful or unenforceable, it is severed and the remainder continues in force.
  • Waiver. Our failure to enforce any right or provision is not a waiver of it.
  • Entire agreement. These Terms, with the policies they incorporate, are the entire agreement between us about the Services, and supersede any earlier agreement or version.
  • Assignment. You may not assign or transfer these Terms without our written consent. We may assign them, including in connection with a sale of the business.
  • Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control, including carrier disruption, supplier failure, natural disaster, or acts of government.
  • Notices. We may give notice by email to the address on your account or order, or by posting to the Services. Notices to us go to support@usbookgram.com.
  • Headings. Headings are for convenience and do not affect interpretation.

23. California consumer notice

Under California Civil Code section 1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
